Justice Sotomayor Blocks Ruling in Favor of Liberal Student Group

A ruling has come down from one of the most liberal Supreme Court justices on the bench, and it took everyone by surprise.

When the case was sent to Justice Sotomayor for review, we expected her to defer to the lower court ruling.

That is not what happened.

Not So Fast

YU Pride Alliance was fighting for recognition as an official student group at Yeshiva University.

The school was trying to block the LGBTQ+ group citing a religious exemption.

Because religion is not mentioned in the school’s charter, the New York Country Supreme Court ruled in favor of the group.

Judge Lynn Kotler ruled that YU must “immediately grant plaintiff YU Pride Alliance the full equal accommodations, advantages, facilities and privileges afforded to all other student groups at Yeshiva University.”

Kotler further stated that the school’s president to be “permanently restrained from continuing their refusal to officially recognize the YU Pride Alliance as a student organization because of the members’ sexual orientation or gender and/or YU Pride Alliance’s status, mission, and/or activities on behalf of LGBTQ students.”

Friday, Justice Sotomayor issued a temporary block on the order.

This is not a permanent order, as the case will now be reviewed, but liberals were stunned that she is even considering the case and not immediately deferring to the lower court decision.
