Florida Judge Strikes Down Biden’s Travel Mask Mandate

Joe Biden and the CDC just took a gut punch from US District Judge Kathryn Kimball Mizelle.

Mizelle, a Trump appointee, has overruled the extension of the travel mask mandate that was extended by the CDC last week.

This is a big win for the travel industry that has been trying to get this order lifted for months.

Not Happening

Last week, the CDC announced, “Since early April, there have been increases in the 7-day moving average of cases in the U.S.

“In order to assess the potential impact of the rise of hospitalizations and deaths, and health care system capacity, the CDC Order will remain in place at this time.”

Yet, during the same week, the Biden administration was also announcing the lifting of Title 42, an immigration rule put in place by the Trump administration to block immigration during the pandemic.

The duplicity confused many.

In response, CEOs of numerous airlines pushed back against the Biden administration, writing, “It makes no sense that people are still required to wear masks on airplanes, yet are allowed to congregate in crowded restaurants, schools and at sporting events without masks, despite none of these venues having the protective air filtration system that aircraft do.”

The letter continued, “We are encouraged by the current data and the lifting of COVID-19 restrictions from coast to coast, which indicate it is past time to eliminate COVID-era transportation policies.”

Judge Mizelle agreed, ruling, “Because ‘our system does not permit agencies to act unlawfully even in the pursuit of desirable ends,’ the court declares unlawful and vacates the mask mandate.”

Sorry, Joe, but you lose again.
