Even though Democrats are going to fight Trump adding another justice to the Supreme Court, President Trump has every intention of putting a name to the Senate this week for confirmation.
President Trump already has a significant list of candidates from which to choose, but word has leaked of the two favorites.
Judge Amy Coney Barrett is getting a lot of headlines as a possible replacement for the late Justice Ginsburg.
Her ties to the late Justice Scalia have made her a popular choice among constitutional conservatives.
However, her limited judicial record is going to be a concern and could create significant resistance from Democrats.
Judge Barbara Lagoa is also believed to be at the top of the list and is probably a far “safer” choice if Trump hopes to get a justice approved before the election.
Lagoa is a conservative, but she is a bit more lenient on some issues, especially where it concerns abortion.
While she is pro-life, she is adamant that precedents are held unless there is overwhelming evidence to overturn them.
Point being, Democrats would probably feel that Roe v. Wade is far safer with Lagoa on the bench than Barrett.
Right now, the numbers are close, with at least two GOP Senators saying they will not vote on a justice before the election and there are surely more, such as Senator Romney (R-UT), that would not vote for Trump.
This means McConnell would have to get some Democrats to flip, which could be nearly impossible in this political environment, but you never know.
