Robert F. Kennedy Jr. is fighting an uphill battle for the right to appear at the big presidential debate on June 27. For all practical purposes, he has the numbers to qualify for a place on the stage. The problem is that those numbers haven’t been certified official. CNN is simply thrilled to be able to use that as an excuse to ice him out.
Debate rules violate the law
If this were really a free and fair election, nobody would have a problem letting the three leading candidates each have their say on the debate issues. Robert F. Kennedy Jr. is running for president as an independent.
Progressives are frantic that voters will see the former Democrat as an alternative to Joe Biden. There’s no doubt that while RFK faces nearly impossible odds, he is indeed a “viable” candidate.
As the deadline rapidly approaches, RFK’s lawyers are accusing CNN of violating federal law.

Excluding him from the first presidential debate in Atlanta, Georgia is essentially a donation to the Biden and Trump campaigns. They issued a press release on June 18 to explain the argument they’re using.
Kennedy had already filed a complaint with the Federal Election Commission “arguing that he faces higher standards to qualify for the debate than his Democratic and Republican rivals.” That point has a lot of weight behind it.
Everyone can see that CNN has carefully phrased the rules to shield Biden from the expected onslaught. It’s set up to be a cage match with each candidate locked safely in their own cage. The second point to RFK’s legal argument is that “his exclusion constitutes a campaign contribution to each of the major party frontrunners.”
Hasn’t been dismissed yet
Kennedy’s team is hanging on to a single thread of hope. They asked the Commission for an expedited ruling on any motions to dismiss, requesting the FEC to do it by June 14 if they were so inclined. It hasn’t been dismissed, which is reassuring but not a decision they can hammer CNN with.
For now, they’re assuming victory by noting “the FEC has now made clear the phrase ‘presumptive nominee‘ is ‘not in the FEC’s debate regulation,‘ and therefore it cannot exempt CNN from the prohibition on excessive campaign contributions.” That means they have a legal leg to stand on.
“CNN, and every member of CNN who is participating in planning, executing, and holding this debate, is at risk of prosecution, as happened to Michael Cohen, for violating campaign finance laws.”
CNN not allowing RFK Jr. on the debate stage isn’t a Democrat/Republican issue, it’s an American issue.

Kennedy can’t file a civil action to break it loose because the law requires him to wait “until the complaint is dismissed or 120 days have passed since its filing.”
Green Party candidate Dr. Jill Stein is so far behind the pack that it’s clear she’s never going to catch up. It’s no surprise that she doesn’t even come close to qualifying.
CNN carefully placed the hoops for candidates to jump through, then cheerfully set them on fire. “To qualify for the debate, candidates must reach CNN’s polling threshold of 15% in at least four approved national polls by June 20. Kennedy has three.“
