The court has finally decided on a date for the hearing on the Trump motion to disqualify Fani Willis from the case, and it is Willis’ worst nightmare.
We all know she wanted to get this case started before the election, but that is not going to happen.
The appeals court set a date for December 5, which is a month after the general election takes place.

This date being moved back to December means that any hope Willis had of trying Trump before the election is over.
Not only that but due to the late date of this case, if Trump wins the election, it is unlikely that Willis will be able to get Trump into a courtroom before he takes office (he cannot be put on trial at that point).
Steve Sadow, the lead attorney for Trump, stated, “The brief persuasively argues that the trial court should have dismissed the case and disqualified DA Willis for her forensic misconduct and the appearance of impropriety between her and former Special Assistant DA Wade, who was her lover and taxpayer-funded financial benefactor.
“We are optimistic that the Court will favorably decide the appeal in our favor.”
The brief for the appeal of the initial decision stated, “Should a prosecutor be disqualified for intentionally and repeatedly violating ethical and professional canons to prejudice defendants for personal or political gain? Yes.
“Is disqualification necessary when a prosecutor testifies falsely, conceals misconduct, and creates ‘an odor of mendacity’ that results in a ‘significant appearance of impropriety?’ Undoubtedly so.
“If this prosecutor deflects attention from her misconduct by claiming on national television that the defendants are dishonest racists for bringing the truthful accusations to light, could anyone have confidence in the impartiality of the prosecutor’s actions? Absolutely not.”
At this point, it is unlikely the initial case will ever see the inside of a courtroom.
Since a sitting president cannot be put on trial, Willis would have to delay the case four years in order to try Trump, and I just don’t see that happening.
If Trump wins, I would expect his Attorney General to dismiss both cases brought by Special Counsel Jack Smith, leaving only the Alvin Bragg case to fight for Trump.
