McIver wrote on X. “But, at the end of the day, this is something I couldn’t let be consumed by this administration. I refuse to let them take my joy or my future.”
The post came from McIver’s own account.
She first announced the pregnancy in May, according to the New Jersey Globe.
McIver was indicted on three counts stemming from a May 2025 confrontation with federal officers at the Delaney Hall immigration detention facility in New Jersey.
She has pleaded not guilty and argued that the arrest interfered with her legislative duties. In August, a federal appeals panel declined to throw out the assault charges against her. No trial date has been set.
Critics accused her of using the pregnancy for sympathy.
Rep. Nancy Mace, R-S.C., wrote, “When getting pregnant is a social media stunt to avoid prison time,” Fox News reported.
McIver did not respond to a request for comment from Fox News.
