Joe Biden’s desire to have men identifying as women to be able to use the women’s room has been halted.
Judge Charles Atchley Jr. blocked the order this week.
Judge Atchley is a Trump appointee.
Overruled
The challenge to the rule was made by 20 state Attorneys General.
Their challenge stated that the Biden administration’s policy made it impossible for them to enforce state rules on this subject.
Judge Atchley agreed and blocked the directive.
The AGs further believed that Biden citing the Supreme Court decision in Bostock v. Clayton County was not done properly.
That case involved a county worker participating in a gay softball league.
The Supreme Court ruled that the actions were a civil rights violation for workplace sex discrimination to extend those rights to sexual orientation and gender identity.
The Supreme Court, in its decision, stated that it was NOT issuing a decision on “sex-segregated bathrooms, locker rooms, and dress codes’ violate Title VII.”
Biden’s Department of Education said that it should be extended to bathroom rights, but Judge Atchley disagreed.
In his ruling, he stated that the Supreme Court “explicitly refused to decide whether ‘sex-segregated bathrooms, locker rooms, and dress codes’ violate Title VII.”
So, again, we have a clear abuse of power by this administration that will likely wind up back before the Supreme Court.
If and when that happens, I would expect the court to kick the decision back down to the lower court’s ruling based on its own precedent.
