Pelosi’s January 6 Select Committee was dealt a pretty devastating loss in court.
This decision, however, could have far-reaching ramifications for the committee.
In addition to the loss in court, the panel hinted that the entire committee could be illegal.
Crushing Blow
At hand were the subpoenas the committee had issued to the RNC.
The committee wanted records for fundraising with Salesforce.
The appeals panel denied the request and dismissed the case.
The ruling stated, “The RNC claimed that disclosure of these documents would reveal sensitive information about its digital strategy, so it sued to prevent the disclosure.
“The RNC argued that the Committee was not lawfully constituted and that the subpoena violated the First Amendment.
“Because the Committee caused the mootness and thereby deprived us of the ability to review the district court’s decision, and given the important and unsettled constitutional questions that the appeal would have presented, we vacate the district court’s judgment.”
The court also called out the committee for what is seemingly a hurry-up-and-wait approach as well as taking as many hits as possible in the hopes that something would stick.
Some legal pundits have pointed to this as well, hinting that the committee has as many poles in the water as possible in the hopes of finding something, anything, that it can use against Trump.
It further stated that there were “important and unsettled constitutional questions” that need to be answered regarding the committee itself.
