Joe Biden’s student loan forgiveness plan is officially on life support.
A Trump-appointed judge halted the program several weeks ago.
That decision was upheld by an appellate court panel, which included an Obama-appointed judge.
Now Biden is begging the Supreme Court for help, and it just about slapped him in the face with its decision.
When We Have Time
Generally, when an administration asks for an expedited hearing, the Supreme Court will grant it.
That did not happen here.
Instead, while agreeing to take the case, the court said it would not hear the case until the next session.
So, arguments will not be heard until February, which means we may not have an actual decision until the spring or summer.
This has forced Biden’s hand to extend the deferment again.
However, more damaging for Biden is the stress level among those who thought they no longer had to pay student loan debt off and spent that money.
There is no reason at all to believe that the Supreme Court will overturn the decision and allow Biden to spend hundreds of billions of taxpayer money without congressional approval.
If the decision is upheld and it is a 6-3 or 5-4 vote, Biden will still be able to use this to rail against conservatives and an “activist” court.
If, however, this decision is unanimous, as it should be, it will be a major hit to Joe Biden and this administration.
We are going to find out a lot about our justices because there is little doubt from constitutional experts (other than the ones that were in Joe’s hip pocket to say what he wanted) that Biden overstepped his bounds significantly by using executive orders and the COVID pandemic to wipe out this debt.
