The Supreme Court has sent a shiver down the spine of the Biden administration.

In the process, the court may have just saved Joe Biden’s presidency.

Only moments ago, the court ruled to keep Title 42 in place until arguments can be heard in February.

Crushing Blow for Biden

Initially, Title 42 was set to expire on December 21.

Due to legal challenges, the Supreme Court extended the rule to this week while it awaited briefs on the challenge.

After having both sides present their case, the court has now ruled that the matter will go before the full court.

This means that Title 42 will remain in place until arguments are heard in February.

It is important to note, however, that once again, a Trump-appointed justice sided with the liberal justices in the case.

The ruling came down 5-4, with Justice Gorsuch siding with the liberal justices.

This is not taking a shot at Gorsuch, just pointing it out for all those that said Trump’s justices would automatically be siding with conservatives in every case.

In his dissent, he wrote, “Even the federal government acknowledges ‘that the end of the Title 42 orders will likely have disruptive consequences.’

“But the current border crisis is not a COVID crisis.

“And courts should not be in the business of perpetuating administrative edicts designed for one emergency only because elected officials have failed to address a different emergency. We are a court of law, not policymakers of last resort.”

I both agree and disagree with him.

I have already stated that I believe that Title 42 will ultimately end because it is a health-related order.

Having said that, since Biden is still using COVID to push certain legislation that he wants pushed, he has to be held to that same standard for Title 42.

He cannot just use COVID when it pleases him.
