Internal emails from former Special Counsel Jack Smith’s office show his team flagged at least six instances between December 2022 and August 2023 in which potentially privileged attorney-client material or other sensitive communications slipped past filter-team reviews, according to Just the News.

The records were obtained through federal open-records requests by The Oversight Project, a nonprofit watchdog.

In an Aug. 3, 2023 email, Smith’s office asked the FBI to search agents’ accounts for a “potentially privileged document” that may have reached investigators, and to purge it.

At a recent Senate Judiciary Committee hearing, Sen. Katie Britt, R-Ala., asked whether Smith’s team observed proper protocols at all times, including the filter team.

Smith answered: “Yes, we sought to do things consistent with the law and department policy.”

Marshall Yates of The Oversight Project told Just the News the emails show violations of those protocols.

The article reports no official finding that rules were broken and includes no response from Smith to the new records. Smith has previously denied wrongdoing.

Just the News notes that the article’s author, John Solomon, is serving as an unpaid special government employee chairing a White House transparency task force.
