The overturning of Roe v. Wade was supposed to send abortion legislation back to the states, but a Florida judge is saying not so fast.
In April, Governor Ron DeSantis signed a 15-week abortion ban into effect.
Even with Roe v. Wade being overturned, a judge put a halt to the legislation, and now the entire country will be watching it.
Valid or Not Valid
So, if you know anything about Roe v. Wade and why it was overturned, this is a really curious case.
Democrats have always claimed Roe v. Wade was about privacy rights, but it never was.
Per Justice Ginsburg, this precedent was ripe to be overturned from the outset because it was about the doctor, not the patient.

This gets interesting because if this ruling holds up, it gives Democrats guidance on where they need to attach abortion to the Constitution to protect abortion federally.
This has always been the worry for pro-life advocates, meaning Democrats would figure out a legitimate way to tie in privacy rights the proper way to protect abortion federally.
While pro-lifers are celebrating this week, that celebration could be short-lived depending upon the outcome of this case.
Governor DeSantis, however, seems confident this law was correctly written.
His office stated, “The Florida Supreme Court previously misinterpreted Florida’s right to privacy as including a right to an abortion.
“We reject this interpretation because the Florida Constitution does not include–and has never included–a right to kill an innocent unborn child.
“We will appeal today’s ruling and ask the Florida Supreme Court to reverse its existing precedent regarding Florida’s right to privacy. The struggle for life is not over.”
No, the fight is not over… it just getting started.
