A lawyer for one of seven former Cornell fraternity members accused in a sexual assault case is asking New York Attorney General Letitia James to step back from the investigation personally, Fox News reported.
James has not been removed, and no court or official has acted on the request. Attorney Andrew Miltenberg made it in a statement to Fox News.
Miltenberg pointed to an earlier Facebook post in which James called what the accuser endured “horrific and unacceptable” and told survivors “we stand with you.” He urged her to “personally recuse herself” and leave the case to senior prosecutors in her office who have not commented.
Gov. Kathy Hochul appointed James’s office Thursday, replacing Tompkins County District Attorney Matthew Van Houten, who had declined to bring charges.
He said the statement his office received from Cornell police did not establish a crime under New York law.
A woman identified as Jane Doe alleges she was drugged and assaulted at the Chi Phi house in October 2024.
She filed a civil suit Sept. 16. No criminal charges have been filed, and the accused deny wrongdoing.
Asked Friday about the post, James said, “I will not comment on a Facebook post,” adding the inquiry would follow “the facts and the law.”
